1. Acceptance of Terms

By accessing or using the GetWork website ("Site"), you agree to comply with and be bound by these Terms and Services ("Terms"). If you do not agree to these Terms, you must not use the Site. These Terms constitute a legally binding agreement between you and GetWork and govern your use of the Site and Services.

2. Description of Service

GetWork provides a platform where clients can purchase fixed-priced projects ("Services"). These projects are predefined, and their scope, deliverables, and price are fixed and non-negotiable. Projects are sold as-is without modification or customization unless explicitly stated otherwise. We reserve the right to modify or discontinue the Services, or any part thereof, at any time without notice.

3. User Accounts

3.1 Account Creation

To access certain features of our Services, you must create an account ("Account"). When creating an Account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your Account password and for restricting access to your Account.

3.2 Account Responsibilities

You agree to:

• Maintain the security of your password and identification.

• Be fully responsible for all use of your Account and for any actions that take place using your Account.

• Notify us immediately of any unauthorized use of your Account or any other breach of security.

• Ensure that you exit from your Account at the end of each session.

• Upload, post, email, transmit, or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships.

• Upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.

• Disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users' ability to engage in real-time exchanges.

• Interfere with or disrupt the Service or servers or networks connected to the Service.

5. Purchases and Payments

5.1 Payment Terms

By making a purchase on GetWork, you agree to pay the specified amount for the selected project. All payments are processed through secure payment gateways. We do not store any payment information on our servers.

5.2 Payment Methods

We accept various forms of payment, including major credit cards, debit cards, and other payment methods as indicated on our Site. You agree to provide current, complete, and accurate purchase and account information for all purchases made via our Site.

5.3 Pricing

All prices are displayed on the Site and are subject to change at any time without notice. Prices for projects are fixed and non-negotiable.

6. Refund Policy

Refunds are not processed back to the user's original payment method. Instead, refunds will be provided as a balance in the user's GetWork account, which can be used for future purchases on the Site. For more details, please refer to our Refund Policy.

7. Intellectual Property

All content, trademarks, logos, and intellectual property rights on the Site are owned by GetWork or our licensors. This includes, but is not limited to, text, graphics, logos, images, audio clips, digital downloads, data compilations, and software. You agree not to reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, GetWork shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service.

• Any unauthorized access to or use of our servers and/or any personal information stored therein.

• Any interruption or cessation of transmission to or from the Service.

• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party.

• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

9. Indemnification

You agree to indemnify and hold harmless GetWork and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

• Your access to or use of the Service.

• Your violation of these Terms.

• Your violation of any rights of a third party.

10. Termination and Suspension of Accounts

10.1 Termination by GetWork

We reserve the right to terminate or suspend your Account and access to the Service at our sole discretion, without notice and without liability, for any reason, including, but not limited to:

• Breach of these Terms.

• Engaging in prohibited activities.

• Non-payment of fees or chargebacks.

10.2 Effect of Termination

Upon termination of your Account:

• Your right to access and use the Service will immediately cease.

• All balances in your GetWork account will be forfeited unless otherwise required by law.

• You will remain liable for all amounts due up to and including the date of termination.

10.3 Chargebacks

In the event of a chargeback by a payment processor or financial institution, GetWork reserves the right to dispute the chargeback and to recover the full amount of the chargeback from you. Your Account may be suspended or terminated until the chargeback is resolved.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. It is your responsibility to review these Terms periodically for any updates or changes.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Punjab, Pakistan, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Punjab, Pakistan.
